PRIVACY POLICY

This Privacy Policy governs the manner in which Oculus Imaging, LLC ("we" or "Oculus Imaging") collects, uses, maintains and discloses information collected from users (each, a "User") of the www.oculusimaging.com website ("Site"). This privacy policy applies to the Site and all products and services offered by Oculus Imaging.
 

Personal identification information
We collect personal identification information from Users when Users register on the site, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, or phone number. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personal identification information, except that it may prevent them from engaging in certain Site related activities.  User information is required to access trial based data specific for each user.   
 

Non-personal identification information
We also collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.  This allows us to tailor our services to the systems most used by our visitors.

 

Web browser cookies
Our Site may use "cookies" to enhance User experience. User's web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.

 

How we use collected information
Oculus Imaging collects and uses Users personal information for the following purposes:

  • To personalize user experience
  • To allow access to secure areas of the web site
  • To send periodic emails

We may use the email address to respond to their inquiries, questions, and/or other requests. If a User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us via our Site.

 

How we protect your information
We adopt appropriate data collection, storage practices, processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.
 
Sensitive and private data exchange between the Site and its Users happens over a SSL secured communication channel and is encrypted and protected with digital signatures. Our Site is also in compliance with PCI vulnerability standards to create as secure of an environment as possible for Users.  All collected data is encrypted at rest to further increase security.

Accessing, Correcting or Deleting your personal information
Oculus Imaging acknowledges that EU, UK, and Swiss individuals have the right to access the personal information that we maintain about them.  An EU, UK or Swiss individual who seeks access, or who:

  • seeks to access, confirm, correct, rectify, update, supplement, anonymize, block, restrict or delete personal information
  • seeks to object to our use of a User’s personal information;
  • has any questions about our processing of the User’s personal information; or
  • would like to transfer your personal information from us to another person or business, should direct their query to jenniferlwoodward@oculusimaging.com.  If requested to remove data, we will respond within a reasonable timeframe. We will provide a User with all rights in relation to the User’s personal information to which the User is entitled under applicable law. We do not use automated decision making regarding your personal information.

 

Sharing your personal information
All collected personal user data is visible to users on their settings page. We do not sell, trade, or rent User's personal identification information to any third party.   We do not transfer user's personal information without consent to a third party.  Should a registered user choose to request privileges to participate in a trial sponsored by a third party ("Trial Sponsor"), they must also consent to share their Name and Email address with the Trial Sponsor. Otherwise they will be given the opportunity to opt out of the trial.  

If we ever were to engage in any onward transfers of your data with third parties for a purpose other than which it was originally collected or subsequently authorized, we would provide you with an opt-out choice to limit the use and disclosure of your personal data.
 
We may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including meeting national security or law enforcement requirements.
 
If you are an EU, UK, or Swiss Individual, where we transfer your personal data to third party service providers who perform services for us or on our behalf, we are responsible for the processing of that data by them and shall remain liable if they process your personal data in a manner inconsistent with the DPF Principles, unless we prove that we are not responsible for the event giving rise to the damage.

Legal Basis
Our legal basis for collecting and processing personal data is based on the agreement we have entered into with a Trial Sponsor.

EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles
Oculus Imaging complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce.  Oculus Imaging has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF.  Oculus Imaging has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.  If there is any conflict between the terms in this privacy policy and the DPF Principles and/or the Swiss-U.S. DPF Principles (DPF Principles), the Principles shall govern.  To learn more about the Data Privacy Framework Program (DPF Program), and to view our certification, please visit https://www.dataprivacyframework.gov/.


With respect to personal data received or transferred pursuant to the Data Privacy Frameworks, Oculus Imaging is subject to the regulatory and enforcement powers of the U.S. Federal Trade Commission.

Pursuant to the Data Privacy Frameworks, EU, UK and Swiss individuals have the right to obtain our confirmation of whether we maintain personal information relating to you in the United States. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data transferred to the United States under the Data Privacy Framework, should direct their query to  jenniferlwoodward@oculusimaging.com. If requested to remove data, we will respond within a reasonable timeframe.

We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. To request to limit the use and disclosure of your personal information, please submit a written request to  jenniferlwoodward@oculusimaging.com

In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Oculus Imaging’s accountability for personal data that it receives in the United States under the Data Privacy Framework and subsequently transfers to a third party is described in the Data Privacy Framework Principles. In particular, Oculus Imaging remains responsible and liable under the Data Privacy Principles if third-party agents that it engages to process the personal data on its behalf do so in a manner inconsistent with the Principles, unless Oculus Imaging proves that it is not responsible for the event giving rise to the damage.

In compliance with the DPF Principles, Oculus Imaging commits to resolve DPF Principles-related complaints about your privacy and our collection or use of your personal information. European Union, United Kingdom, and Swiss individuals with inquiries or complaints regarding our handling of personal data in reliance on the DPF should first contact  jenniferlwoodward@oculusimaging.com

Oculus Imaging has further committed to refer unresolved privacy complaints under the Data Privacy Principles to an independent dispute resolution mechanism, the BBB Data Privacy Framework Program operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit  https://bbbprograms.org/programs/all-programs/dpf-consumers for more information and to file a complaint. This service is provided free of charge to you.

If your Data Privacy Framework complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. Changes to this Privacy Policy 
Oculus Imaging has the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Your acceptance of these terms
By using this Site, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
